Terms & Conditions
(Christmas Mini Events)
All sessions are subject to the following terms and conditions.
By booking a session with Angela Vidal Photography you confirm you have read, understand and agree to these terms and conditions.
3. Booking and Payment
3.1 Upon booking, the Client will pay a session fee of $150. For this fee, Angela Vidal Photography will not accept other bookings for said date and time. For this reason, while the reservation can be transferred to another event, if the session is cancelled by the Client for any reason, it will become a cancellation fee.
3.2 This payment includes;
a) The reservation of your session time and date
b) Up to 20 minute portrait session in studio
c) Five high resolution images selected and professionally retouched at the discretion of Angela Vidal Photography delivered via private online gallery
4. Rescheduling
4.1 Client may reschedule the session once within six months of the original booking without charge so long as the Client contacts Angela Vidal Photography at least 24 hours before the start of the session. Any further reschedule requests will incur a new session fee.
5. Arrival time
5.1 The client is responsible for ensuring everyone required arrives at the appointment on time.
5.2 The session will begin at the stated time and no earlier. The session will not be extended for late arrivals and will end at the scheduled time regardless.
5.3 A session cannot be completed if you are more than 10 minutes late to your appointment. After this time, the session may be marked as a "no show" and the session cancelled, at the discretion of Angela Vidal Photography.
6. Liability
6.1. In the unlikely event that the Photographer is injured, ill or medically unable to photograph the session, Angela Vidal Photography will make every effort to reschedule the session for the next suitable date for all parties at no additional cost, or return the Client's reservation fee should we be unable to reschedule.
6.2 If Angela Vidal Photography is unable to fulfill this agreement due to fire or other casualty, strike, act of God, or other causes beyond our control, we will return in full all payments made by the client to Angela Vidal Photography in relation to the session, and Angela Vidal Photography will have no further liability with respect to this agreement.
6.3 Although we will exercise all reasonable skill, care and diligence in the discharge of our duties, in the unlikely event of equipment failure or if the images are lost, stolen, damaged or destroyed for reasons within or beyond the control of Angela Vidal Photography, liability is limited to the return of all payments received for the session.
6.4 Although Angela Vidal Photography will do our best to prevent accidents and/or incidents, the Client releases all employees and subcontractors for Angela Vidal Photography from all liabilities, claims and damages that may result from any accidents or incidents that may happen during the session.
6.5 Angela Vidal Photography is not responsible and bears no responsibility/accountability for the quality of services (printing or other) provided by its business partners or other third parties.
6.6 The Client is responsible for the download, storage and backup of the images supplied by the Photographer. While Angela Vidal Photography will follow our usual backup procedures (if any) upon delivery of the image gallery, Angela Vidal Photography shall not be liable under any circumstances if unable to produce backups or future reproductions of the images upon the request of the Client. Where backups are available, these may be made available to the Client for a fee.
7. Damage to Property or Equipment
7.1 The client will be responsible for any damages caused to the Angela Vidal Photography's property or equipment that arises from misuse or destructive behaviour.
7.2 General wear and tear is not the responsibility of the client.
7.3 Damage that is caused by the client or accompanied persons will be charged to the client to the value of replacement or repair of damaged property/equipment. The client assumes responsibility of accompanying persons including guests and children bought to the session.
8. Digital Images
8.1 The package purchased by the client upon booking will determine the amount of images provided in the gallery, and no additional images will be available to purchase.
8.2 Angela Vidal Photography will use our professional judgment and sole discretion to select which images to present to the Client (the gallery). Such selection shall constitute all images that will be made available to the Client. Images determined by the Photographer to be substandard will be deleted.
8.3 All post-processing is at the Photographer’s discretion, and the images delivered are the Photographer's final work. Any additional editing requests will incur an additional fee charged at the rate of $100 per hour of editing time.
8.4 The standard time frame for delivery of the gallery is ten working days from the session date, providing the balance of the package invoiced has been paid in full. Late payment will result in late delivery.
8.5 A Priority Gallery can be delivered within 72 hours for an additional $150. Please note this priority fee is for digital images only and not products.
8.6 Due to the custom nature of photography, all sales are final and no refund will be issued once images have been delivered.
9. Ordering of Photographic Products
9.1 The client acknowledges and agrees that upon placing an order through Angela Vidal Photography, they have a maximum period of 30 days from the date of order placement (the "Confirmation Period") to finalise and confirm their order details, including but not limited to product specifications, quantities, and shipping information.
9.2 Orders will be processed upon the invoice being paid in full, meaning products are normally ready within four to six weeks of payment being received. However, failure to make the required payment by the invoice due date may result in delays in production, shipment, or availability of the ordered product. Angela Vidal Photography shall not be held responsible for any such delays and reserves the right to adjust the delivery schedule accordingly.
9.3 In the event that the Client has paid for the order but has not confirmed the details within the Confirmation Period, the Angela Vidal Photography reserves the right to make final decisions on product specifications, quantities, and any other relevant details necessary to proceed with the order. Angela Vidal Photography will make reasonable efforts to align these decisions with the client's original preferences to the best extent possible.
9.4 The Client will have the option to collect the order from the studio or have it delivered for a fee.
9.5 Due to the custom nature of photography, all sales are final and no refund will be issued once products have been ordered.
10. Client Satisfaction
10.1 In the unlikely event the Client is completely dissatisfied with the final results, Angela Vidal Photography may offer a reshoot at no additional cost to the Client, at our discretion.
10.2 Reshoots will not be offered for;
a) Clients who do not follow guidance or directions provided by the Photographer, verbally or in the Preparation Guide provided before the session;
b) Any unwilling or uncooperative participants; or
c) Regrets about styling choices (including backdrops, props, cakes, wardrobe, makeup or hair for the session.
10.3 Any reshoot will render all images from the original photo session null and void, and they will not be available to the Client to download.
11. Privacy and Personal Information
11.1 Personal information collected by the Photographer shall be retained in the Photographer’s database. The Client may request correction of any of the Client’s personal information by contacting the Photographer.
11.2 The Photographer shall abide by the Privacy Act 1993 and take all practical steps to achieve privacy protection.
12. Illness & Covid-19
12.1 Angela Vidal Photography has a zero tolerance policy towards illness. The Client agrees to reschedule if they or any attending family members are sick, (including vomiting and diarrhoea, high temperatures, conjunctivitis, rashes or any other infectious/contagious illnesses), anyone in the party is awaiting Covid-19 test results or has been in a location of interest.
12.2 Sessions will not go ahead with any attendees clearly unwell. To ensure the protection of others visiting the studio, the session will be rescheduled.
13. Copyright
13.1 All photographs taken by Angela Vidal Photography are her property, will remain her property and are protected by New Zealand Copyright laws.
13.2 The Client hereby waives any claims for ownership, income, editorial control and non-personal use of the images. Violators of this law will be subject to its civil and criminal penalties.
14. Model Release
14.1 The client hereby consents and agrees that Angela Vidal Photography has the right to photograph you and/or your child(ren).
14.2 The Client hereby certifies that he/she is the parent or legal guardian of any minor(s) as listed on the booking form, and has the legal right and authority to execute the model release as stipulated in this agreement, on behalf of the minor(s).
14.3 The client grants the Photographer the right to use images for promotion of work. This includes publication in portfolio, social media platforms, print and photographic competitions.
